  2. EASEMENT AGREEMENT

  5. Darryl Dockowner, referred to as OWNER, and Gary Gotyacht, 
  6. referred to as GRANTEE, agree:
  7.

  9. OWNER is the owner in fee simple of the following described real 
  10. estate:

  13. See exhibit 1, legal description of property
  14.

  16.  
  17. In consideration of $ 500.00 ( five hundred & no/100 dollars) 
  18. paid by GRANTEE, the OWNER grants to GRANTEE an easement:
  19.  
  20.  
  21. to use the dock located at Lot 7, Bay Lakes Estates, for a term 
  22. of 5 years.
  23.  
  24.  
  25. The grant of easement herein shall bind the heirs and assigns of 
  26. the OWNER; however, GRANTEE may not assign the rights hereunder 
  27. without the consent of OWNER. The rights herein shall be 
  28. specifically enforceable.
  29.  
  30. This easement shall be further subject to the following:

  33. (a) In the event that GRANTEE causes any damage or undue wear and 
  34. tear on the dock, GRANTEE shall promptly reimburse OWNER for the 
  35. expense thereto:
  36.  
  37.  
  38. (b) In the event of destruction of the dock due to casualty, 
  39. OWNER shall promptly rebuild the dock; however, the easement 
  40. shall abate during the time of rebuilding, and monetary damages 
  41. shall not be due from the OWNER to the GRANTEE;
  42.  
  43.  
  44. (c) In the event that government regulation forbids or limits the 
  45. right of use of the dock, GRANTEE shall be bound thereby.
